Terms & Conditions of “Web Services for Extracting Statistical Data”

These terms and conditions apply to the relationship between the Securities Depository Center (SDC) and any user who has submitted a request to subscribe to the " Web Services for Extracting Statistical Data" service provided by the SDC through its official website. These terms constitute an integral part of the user's subscription form submitted to the SDC for this purpose.

The user acknowledges that they have read, understood, and agreed to these terms and conditions, without prejudice to the SDC’s right and authority to amend these terms and conditions, or any part thereof, at any time. Such amendments shall become effective from the date the user is notified, in the manner the SDC deems appropriate. In order to activate this service and enable the user to benefit from it, the user must agree to all the terms and conditions outlined below.

1. The following words and phrases shall have the meanings assigned to them below, wherever they appear:

• SDC: Securities Depository Center
• User: The legal entity whose subscription to this service has been accepted. This includes public shareholding companies, or securities issuers, or financial brokers, or custodian members of the SDC, as well as any company or institution whose objectives include obtaining, analyzing, and utilizing such data in a manner that benefits the Jordanian capital market.
• Service: The "Web Services for Extracting Statistical Data " service provided by the SDC through its official website, which the SDC agrees to make available to the user in accordance with the procedures and mechanisms established for this purpose.

2. Use of this service shall be limited to the subscribed user only, who shall bear sole responsibility for the use of the service and the utilization of the information and data provided through it.

3. The service enables the user to automatically and efficiently access a wide range of comprehensive statistical data related to the securities registered with the SDC, through the mechanism of direct connection with the SDC by using Web Services technology. This allows the user to store, analyze, and utilize the data to achieve their objectives.

4. The user acknowledges the SDC’s right and authority to suspend, cancel, or restrict the service, in whole or in part, at any time and for any duration the SDC deems appropriate, without the need for prior notice and without providing any reasons.

5. The SDC has the right, at any time, to set specific fees or charges for subscribing to this service. In such a case, the user's continued subscription shall be conditional upon the payment of those fees or charges as determined by the SDC for this purpose.

6. The user acknowledges full responsibility for safeguarding and ensuring the confidentiality of the login credentials provided by the SDC upon subscribing to the service. The user must also ensure that no unauthorized access to the service occurs through their login credentials and shall bear all responsibilities arising otherwise.

7. Any person using the username and password to access the service shall be considered the authorized user. The SDC shall bear no responsibility for any misuse of the service in any form.

8. The user shall bear sole responsibility for any consequences arising from the use of their username and password by any third party to access the service, whether such use was authorized by the user or not. The SDC shall not bear any responsibility for any resulting damage.

9. The user is responsible for safeguarding their username and password and ensuring they are stored in a secure location. In the event of losing the username and/or password, the user must contact the SDC directly.

10. The user acknowledges that the data and information accessible through the service are exclusively available at the SDC, which is the sole entity authorized to disclose and publish such data in accordance with the applicable laws and regulations. The user also acknowledges that this data and information are by nature subject to change and are updated daily based on the transactions and operations recorded in the SDC’s records.

11. The user acknowledges that the data and information made available through the service are the exclusive property of the SDC. The user agrees that in using this data whether by printing, transferring, publishing, or by any other means or form the source of the data and information must be clearly cited. This citation must be included as a written note placed in a prominent and easily visible location, clearly indicating that the source of the data and information is the SDC.

12. The user acknowledges that their use of the data and information obtained through the service is strictly limited to purposes that serve their business and support the achievement of their objectives. Accordingly, the user agrees not to provide such data or information to any third party under any contracts or agreements made for this purpose. The user shall bear full legal and financial responsibility for any use of the data and information that violates this condition, contradicts any applicable laws or regulations, or causes harm to the interests or operations of the SDC, any securities issuer, or any other party in any manner whatsoever.

13. The update of the data available through the service is subject to the latest update performed by the SDC on its database, which is displayed to the user upon accessing the service.

14. The SDC bears no responsibility for any errors or defects in the software used by the user, or for the user's use of any software or devices that may compromise the security and effectiveness of the service. The SDC is also not liable for the presence of viruses on the user's devices or for weaknesses in the security systems or software used. The user shall bear sole responsibility for all consequences resulting from such issues.

15. The user acknowledges that they have understood all the terms and conditions related to the use of this service. Their use of the service is subject to these terms and conditions, in addition to any other terms the SDC may apply from time to time. The usage instructions for this service, as well as any provisions included in the written acknowledgement signed by the user and attached to the subscription form, shall be considered an integral and inseparable part of these terms and conditions.
